The State of Georgia has passed two new laws to hopefully reduce car accidents caused by distracted drivers.

1. Senate Bill 360 (No texting while driving):

“No person shall operate a motor vehicle on any public road or highway of this state while using a wireless telecommunications device to write, send, or read any text based communication, including but not limited to a text message, instant message, electronic mail, or Internet data.”

The fine for offenders will be $150 and one point on the driver’s license. 

2. House Bill 23 (No cell phone use by minors):
This new law “prohibits use of wireless telecommunications devices by persons under 18 years of age with an instruction permit or Class D license while operating a motor vehicle”.

The fines are also $150 and one point on the driver’s license.   

“Driving” includes sitting at a red light or stop sign.

Mold is a relatively common household occurrence that can potentially cause health problems as well as damage to structures and surfaces. Although most molds are harmless, some can cause serious respiratory problems, especially in sensitive individuals, so it’s important to be aware of potential mold growth in your home. As with most things, a little knowledge goes a long way - read below for information that will help you identify a mold problem.

Mold Basics:
Mold enters your home as tiny spores, which need moisture to begin growing, digesting and destroying. Mold can grow on almost any surface, including wood, ceiling tiles, wallpaper, paints, carpet, sheet rock, and insulation, given the right conditions.

Identifying the Problem:
Mold most often appears as small black or white specks in places like your damp bathroom or basement walls. To the unaided eye, mold has a variety of appearances: fuzzy, velvety, leathery, powdery, and glassy. Mold colonies may appear to be black stains or patches of white, yellow, green, brown, black, gray, or even pink. Some mold may be hidden behind wall coverings or ceiling tiles, but is often visible to the naked eye.

Where to Look:
Mold grows best when there is an abundance of moisture, so it is often found in areas with water damage or excessive humidity. Mold can also be found growing along walls where warm moist air condenses on cooler wall surfaces, such as behind dressers, headboards, and in closets where articles are stored against walls. Mold often grows in rooms with both high water usage and humidity, such as kitchens, bathrooms, laundry rooms, and basements.

Trust your nose:
The compounds produced by molds have strong smells, which are volatile and quickly released into the air. Because these compounds often have strong or unpleasant odors, they can cause a “moldy” or musty smell frequently associated with mold growth. A musty odor suggests that mold is growing in the building and should be investigated.

Fast and Furious:
If you suspect a mold problem, you should address the issue as quickly as possible, as mold can spread quickly. You can successfully clean up a small amount of mold yourself using a simple solution warm water and soap, but larger infestations should be removed by a professional mitigation expert.

Purchasers who are trying to meet the June 30, 2010, closing deadline to qualify for the first-time homebuyer credit or move-up homebuyer credit should probably look at properties that do not need flood insurance.

The National Flood Insurance Program (NFIP), which is the federal program that funds almost all flood insurance claims, has actually expired twice already in 2010.  Although the program has now been extended to May 31, 2010, (retroactive to the last expiration) there have been weeks in 2010 when flood insurance was not available, and many closings had to be postponed.  The most recent extension was approved on April 15, 2010, in the same bill that extended some jobless benefits.

Although flood insurance is bought through local insurance companies, the NFIP is the ultimate provider of the policy (similar to FHA underwriting of loans made by banks and mortgage companies). Devastating floods and claims have depleted the cash available in the NFIP.

Flood insurance through the NFIP is not the same as federal flood assistance, which can be a government grant or a loan based on a specific flood crisis. Any community that participates in the NFIP is eligible to purchase flood insurance.

Flood Insurance Limits for a residence:

$250,000 for the dwelling             $100,000 for contents

April 1st marks the beginning of the 2nd quarter of the year, and there are some deadlines and issues to consider in selling, buying, or managing real estate.
 

1.      Income tax:  Filing deadline is April 15, 2010 (for 2009 income).Tax returns are required for almost all mortgage applications and short sale applications, especially if the closing will take place after April 15th.

2.      First Time Homebuyer Credit (up to $8,000) and Move-Up Homebuyer Credit (up to $6,500). Contract must be signed by April 30, 2010. Closing must take place by June 30, 2010 

3.      FHA upfront MIP increases from 1.75% to 2.25% for any FHA case numbers issued starting on April 5, 2010. Make sure that your buyer’s case number has been issued for an FHA loan application, or make sure that the buyer gets a revised Good Faith Estimate.

4.      Home Affordable Foreclosure Alternatives program goes into effect on April 5, 2010. This program gives incentives to lenders to expedite and streamline the short sale process.

FHA has recently announced significant changes to FHA loans:

1. The initial upfront MIP will increase from 1.75% to 2.25%, effective for any FHA case numbers issued starting on April 5, 2010.

2. The holding period of 90 days for a seller (to an FHA purchaser) has been waived for contracts executed on or after February 1, 2010. This applies to foreclosures and investors (still reviewed on a case-by-case basis).

The following changes will go into effect in the summer of 2010, because they must go through an official approval process, including publication in the Federal Register:

1. Borrowers will need a minimum credit score of 580 to qualify for the maximum loan percentage with only 3.5% down.

2. Borrowers with less than a 580 credit score will be limited to a maximum of 90% financing (10% down).

3. Seller concessions will be limited to 3%.

When looking back on the year he opened the first Keller Williams Realty office in Atlanta, franchise owner Shaun Rawls thought about the efforts he made to inform people about the Austin, Texas-based company.

3) The timing of pending foreclosure actions
4) Borrower motivation and cooperation

Benefits:

1) Provides process for short sale pre-approval prior to listing or contract
2) Lender can not foreclose during HAFA process
3) May allow seller to receive some proceeds for moving (up to $1,500)
4) Allows small allocation to subordinate loan payoffs (up to $3,000)
5) Borrowers are fully released from future liability on the first mortgage (no note or deficiency judgment)
6) Protects realtor commissions up to 6% as shown in listing agreement
